Judge issues restraining order on immunization mandate

ALBANY—A state Supreme Court judge has issued a temporary restraining order blocking the mandate that all health care workers in the state to be vaccinated for seasonal and H1N1 flu viruses.

Judge Thomas McNamara issued the order Friday following a hearing on the issue following lawsuits by the New York State Public Employees Federation (PEF), the New York State United Teachers and a private lawsuit brought by Albany attorney Terry Kindlon.

State Health Commissioner Richard Daines had decreed that certain health care workers be vaccinated by Nov. 30 or face possible disciplinary action including job termination.

Kinlon said such a mandate was unconstitutional and that New York is the only state in the country to require such “involuntary vaccinations”.

Another hearing on the issue will be held Oct. 30.

We should have a better idea after that hearing, what the final word is.  Thank you to PEF, the NYS United Teachers and Terry Kindlon.  That’s what I’m talking about!

Glad I waited.
