A friend alerted me to this today - check out the legal notices in today’s paper.
LEGAL NOTICE BRIEF SYNOPSIS OF DETERMINATION AND FINDINGS PURSUANT TO ARTICLE 2 OF THE NEW YORK STATE EMINENT DOMAIN PROCEDURE LAW The Rochester Genesee Regional Transportation Authority (”RGRTA”) shall acquire certain parcels of real property by eminent domain for the construction and operation of Renaissance Square, a development project with Monroe County and Monroe Community College (”MCC”) that will include a transit facility, a community college and supporting components (the “Project”) in the City of Rochester, County of Monroe and State of New York.

The foregoing notwithstanding, Section 1299-ii of the Public Authorities Law provides RGRTA may not acquire real property by condemnation or by purchase for purposes other than a transportation facility unless the governing body of the city in which such real property is located shall first consent to such acquisition. As acknowledged during the public hearing, RGRTA will not acquire any property “for purposes other than a transportation facility” without the prior consent of the Rochester City Council. CYR-2x
I suppose this needed to be filed but in the end, City Council is in the driver seat. Somehow - a smaller transit facility that meets the city of Rochester’s needs is coming. Perhaps more importantly, the Performing Arts Center, that unfunded future deficit generating albatross around the City’s neck will won’t fly.
