Greece Suspends Police Chief without pay

Last time Merritt Rahn was suspended it was with pay - however, the Greece Town Board just voted to suspend him and others without pay.

Greece officials have lodged more than 40 administrative complaints of misconduct, malfeasance or incompetence against suspended Police Chief Merritt Rahn, who was suspended without pay early today after an internal investigation determined he had violated departmental regulations.

Also suspended without pay today was Deputy Chief William Mackin, against whom 30 disciplinary charges were filed.

Anyone know if the complaints are “public” yet?

    Apparently the town board voted earlier today to suspend without pay. Was thier meeting publicized? Don’t open meeting laws require that it be? If so, the complaints should be public.

    There is no doubt that they will paint this as them taking control of the situation, but the reality is that it is just a smoke screen to take the focus off of their incompetence. Most recently discovered is that Auberger almost lost the town’s police accreditation because of his hiring practices. Those same practices led to the hiring of Nick Joseph and Gary Pignato. I can’t wait to see the campaign literature saying what a hero Auberger is.

    Good point about the town board meeting and if it was indeed public.

    It may not have been because of the personnel action and they likely went into executive session but some form of announcement should have been made.

    It’s likely it was an emergency board meeting. I believe no notice is required, but minutes must be posted. As it was a personnel issue, it’ll basically say it went into executive session, came out, chief and deputy chief suspended without pay (details discussed in exec session), adjourned and that’s it. Doesn’t even need to be the full board - just a quorum.

    Personnel issues are exempt from the open meetings law. Even if this matter were considered during a regular meeting, the board would go into executive session.
