No more fun for Tom Reynolds

As we reported earlier, Tom Reynolds has resigned. Tonight, on Channel 13 News, he made the statement:(paraphrased, cause I can’t find the link)

“When I was in the majority, I was having fun. Now that I’m in the minority, I’m not having fun anymore”

[update 3/21/08 21:56- stlo7 here. Actually paraphrase is pretty close. Here is the Channel 13 link]

“I recognize that I’m in the minority,” Reynolds (R-NY) said. “I’m not having quite the amount of fun in the minority that I had in the majority.”

Well, isn’t that a shame? And while you were having your fun, how was Western NY faring with rising fuel prices, lack of health care, jobs being relocated overseas, property taxes through the roof, home foreclosures, sons and daughters being sent to an endless war in Iraq?

Fun?

What a putz!

    Well a nice trip to Florida to go visit with “Uncle Markie” Foley should be sufficient to having those four grandchildren know everything they need to know and more about their grandfather.

    Well, Reynolds was in charge of the page program remember? Getting Foley to run again despite probably being aware of the goings on with Mr Foley. Oh, I suppose being knee deep in the NRCC scandal didn’t help either.

    Re “singing praises in other posts about Scott Ritter”

    Well - looks like the misdemeanor charges were ultimately dismissed. The charges sealed, A “source” said something about what you mentioned. it sounded damning actually. Here is a CNN story.

    The question has to be if there was a case - why isn’t there a conviction? And I’m not talking about pardons here AKA Ollie North or sentence commutations AKA scooter Libby.

    There is no such thing as being “leagally or ethically” obligated not to discuss a “sealed case” if you’re the defendant and you have received an ACD in the past.

    What possible legal or ethical boundry can be crossed when an innocent man proclaims his innocence? I know he’s presumed innocent but this is a different matter. An ACD is not the same as being found not guilty or having the charge dismissed in the interest of justice. It means if you don’t do it again, we won’t prosecute. If you muck-up we do.

    Furthermore, ACD cases are not “expunged as if they never happened.” The case is dismissed, but the record is not expunged.

    Either Ritter doesn’t know what he’s talking about or he’s blowing a little smoke in our direction.

    But hey,

    I’m glad Reynolds is retiring. Because having fun is really what being a congress member is all about! And if Tom isn’t having fun funding endless wars, and taking health care away from children what’s the point?

    Well, don’t . You are disagreeing with Ritter’s words or his interpretation not mine. I said the charges were ultimately dismissed. But I found this interesting.

    8. The granting of an adjournment in contemplation of dismissal shall not be deemed to be a conviction or an admission of guilt. No person shall suffer any disability or forfeiture as a result of such an order. Upon the dismissal of the accusatory instrument pursuant to this section, the arrest and prosecution shall be deemed a nullity and the defendant shall be restored, in contemplation of law, to the status he occupied before his arrest and prosecution.

    I’m not a lawyer but sounds like it.

    Regardless - further discussion over this is a distraction brought forward by whtwtrdood . If there was something here, really something here, wouldn’t it have gone further? That was my point.

    The case never went any further because the Albany County DA screwed it up. I wouldn’t worry though, unless Mr. Ritter is able to keep his penchant for 14 year-old girls in check, it’s just a matter of time before another DA can try him. Maybe the UN can send him to Thailand to inspect weapons programs there.

    As far as Reynolds goes, feh. There hasn’t been a decent Congressman representing that part of the state since Barber Conable retired.

    From what I can tell - charged and dismissed in 2001. Reopened and investigated in 2003 at the Federal level. Can’t tell if closed there. Silence since except - endless comments on WorldnetDaily and conservative blogs. What did I miss?

    From a due process perspective where does the scarlet letter fit in and which one should be used?

    To me, what’s most interesting is the claim that the reason he’s not running again is that it’s not fun anymore. At least it’s honest, and it reflects so much of the underlying belief system of the current crop of Republicans. It’s all about them - what they can get out of it, whether material, or, as Reynolds points out, some “fun”. What about going into public service for…er….uh…the public? What about doing a hard job because you are trying to help others than yourself?

    ACD - the case is ultimately dismissed. (Adjourned in contemplation of dismissal.)

    Ultimately, the record is considered a disposition in favor of a defendant, and the records are sealed to almost all parties. There are certain exceptions in the law as to who may have access to sealed records.

    There are many reasons a defendant can be offered an ACD - but they can’t get the offer and accept it unless the prosecutor agrees. Sometimes it’s lack of evidence, sometimes it’s weakness of the case, sometimes it’s reluctance of the witness.

    There is also a difference between a record being sealed and being expunged.

    ACD’s are not expunged.

    No Scarlet Letter. The charge was dismissed. But Ritter’s not being straight about it either.

    Why this important? Because it casts a shadow on the man’s credibility. And we fawned over him and his accusations there were no WMDs when he came to Rochester.

    Back on point, this isn’t about Ritter’s indiscretions it’s about Reynolds’ not doing his job.

    Ritter wasn’t elected, Reynolds was. Reynolds didn’t folow through the way he should have. An act of ommission that was wrong.

    What if the Republicans felt that Reynolds couldn’t win against Powers so they’re having him step down so they can run someone competitive?

    Rumor on the street has it that “Little John Auberger” is in top contention for the replacement roll. This should be good. Between all of the lawsuits over prayers, the criminal trials over the Assessor, his past indiscretions with Maggie Brooks, and his health issues and mealy mannerisms, this is fantastic news!

    I believe you’ll find “the street” either doesn’t know what it’s talking about or is just engaging in a bit of wishful thinking. The Republican power of the 26th District has always been wielded from the Far Western Counties and this will be no exception. If the candidate doesn’t come out of either Erie or Niagara County I would be awfully surprised.
