More information on the Marriage Decision and Appeal

We need to continue to fight the good fight, and since knowledge is power, let’s find out what we’re fighting for.  Let’s learn about this court decsion and how it impacts the community at large. Monday evening, we will have the opportunity to do just that.

Fitzhugh St., Hallock Lounge (1st Flr) For more info cntct Todd Plank @ 585.278.4190; Co-sponsored by the New York Civil Liberties Union, Genesee Valley Chapter and the Empire State Pride Agenda; Guest Speakers: Matt Faiella, NYC Staff Attorney for the NYCLU, local couple Pat Martinez & Lisa Ann Golden & their Rochester attorney Jeffrey Wicks, Gary Pudup, Executive Director of the NYCLU, Genesee Valley Chapter.  An Informational meeting on the decision of the NYS Appellate Court, 4th Dept. in Martinez v.County of Monroe with the purpose of educating local same-sex couples, the LGBT community and the general public at large about both what we do know and what we don’t yet know about the legal standing of same-sex couples residing in NYS who have been married outside of NYS (predominately Canada, some Massachusetts).In addition to providing some background on the Martinez case, some key issues/questions to be addressed are: Immigration & marriage recognition; How soon can New York “newlyweds” lay claim to the 1,324 rights and responsibilities extended through marriage in NYS? What are the implications of the automatic stay pending a possible appeal to New York’s highest court? What are important considerations for couples contemplating crossing the border to Canada and getting married? There will be plenty of time allowed for Q&A. Light refreshments will be served. Paige is confused. Paige is not a legal expert.

A court makes a decision. If one of the parties in the case isn’t happy with the court’s decision, one of the parties in the case can appeal to a higher court. I understand that.

A party not involved in the case (Monroe County aka Maggie Minarik) is not happy with the decision. On what grounds do they have a right to appeal the decision?

Because the suit involves Monroe County. “Martinez v.County of Monroe”

Either party can appeal until they run out of options.
