Kerik will be indicted tomorrow was indicted today and will surrender tomrrow

We said earlier that Giuliani crony Bernie Kerik would probably be indicted soon. It’s all but official now:

Bernard Kerik, the police commissioner under former Mayor Rudy Giuliani who nearly became head of the Homeland Security Department, will surrender to federal authorities Friday on criminal charges, an official said Thursday.

The federal law enforcement official said prosecutors plan to announce the filing of an indictment against Kerik at a news conference Friday. The official spoke on condition of anonymity because of the secrecy of grand jury proceedings.

    This probably means he’s already indicted and a warrant has been issued based on the indictment. My understanding is that the Grand Jury decides whether to indict somebody, and if they do, it’s only after that a person would turn themselves in on an indictment. Although a Grand Jury may indict, the information about whether someone is indicted is not always made public at the time of the indictment. That often happens at a later date.

    Looks like he’s being arraigned on an indictment tomorrow. That’s when a defendant is advised of the charges filed against him/herself, advised of his/her rights, and a bail determination is made.
